1. These terms and conditions

1.1 This is the Privacy and Cookie Policy (the "Policy") for www.acenden.com (the "Site"). The Site is operated by Acenden Limited ("we", "us" and "our"). For the purposes of the General Data Protection Regulation 2016 and the Data Protection Act 2018 (together “the Data Protection Legislation”), we are the data controller. 

1.2 We are committed to protecting your privacy on-line. This policy explains how we collect information, what we do with it and what controls you have.

1.3 By using the Site, you consent to the collection and use of information in accordance with this privacy policy.

1.4 We reserve the right to change this privacy policy from time to time by changing it on the Site. This privacy policy was last updated on 25 May 2018.


2. Who we are

2.1 We are authorised and regulated by the FCA and we are an associate member of the Council of Mortgage Lenders.


3. Access to the Site

It is your responsibility to ensure your computer system meets all the necessary technical specifications to enable you to access and use the Site and is compatible with the Site.


4. Permitted use of the Site

You may only use the Site for your internal business purposes and only in accordance with these Terms of Use. You must not use the Site for any other purposes without our permission. You may retrieve and display content from the Site on a computer screen, print and copy individual pages and, subject to the next section, store such pages in electronic form. Additional terms may also apply to certain features, parts or content of the Site and, where they apply, will be displayed before you access the relevant features, parts or content.


5. Prohibited use of the Site

5.1 Except to the extent expressly set out in these Terms of Use, you may not:

  • store pages of the Site on a server or other storage device connected to a network or create an electronic database by systematically downloading and storing all of the pages of the Site;
  • remove or change any content of the Site or attempt to circumvent security or interfere with the proper working of the Site or the servers on which it is hosted; or
  • create links to the Site from any other website, without our prior written consent, although you may link from a website that is operated by you provided the link is not misleading or deceptive and fairly indicates its destination, you do not imply that we endorse you, your website, or any products or services you offer, you link to (and do not frame or replicate) the home page of the Site, and the linked website does not contain any content that is unlawful, threatening, abusive, libellous, pornographic, obscene, vulgar, indecent, offensive or which does or may damage our reputation (in our reasonable opinion) or infringes on the intellectual property rights or other rights of any third party.

5.2 You must only use the Site and anything available from the Site for lawful purposes (complying with all applicable laws and regulations), in a responsible manner, and not in a way that might damage our name or reputation or that of any of our affiliates.

5.3 All rights granted to you under these Terms of Use will terminate immediately in the event that you are in breach of any of them.


6. Intellectual property rights

All intellectual property rights in any content of the Site (including text, graphics, photographs and other images, videos, sound, trade marks and logos) are owned by us or our licensors. Except as expressly set out here, nothing in these Terms of Use gives you any rights in respect of any intellectual property owned by us or our licensors and you acknowledge that you do not acquire any ownership rights by accessing or using in any way any content from the Site. If you print, copy or store pages from the Site (which you may only do as permitted by these Terms of Use), you must ensure that any copyright, trade mark or other intellectual property right notices contained in the original content are reproduced in full.

8.1 We may change the format and content of the Site from time to time. You agree that your use of the Site is on an 'as is' and 'as available' basis and at your sole risk.

8.2 All content on this Site is provided for your information and for illustrative purposes only, and does not constitute advice. We neither make nor give any representation or warranty to you or to any of your customers as to the accuracy, completeness, currency, correctness, reliability, integrity, quality, fitness for purpose or originality of any content of the Site and, to the fullest extent permitted by law, all implied warranties, conditions or other terms of any kind are hereby excluded. If you want to rely on any information provided in this Site, you should check its currency and accuracy directly with us, before placing any reliance on it. We do not guarantee that the products and services advertised on this Site will be suitable for any of your customers.

9.1 We are not responsible if you cannot access our Site properly or at all and we cannot guarantee that our Site will be error-free or will work all the time.

9.2 Nothing in these Terms of Use shall limit or exclude our liability to you for death or personal injury caused by our negligence or for fraudulent misrepresentation or any other liability that may not, under English law, be limited or excluded. Subject to this, in no event shall we be liable to you for any indirect or consequential losses incurred by you, or for any loss of profit, revenue, contracts, data, goodwill or other similar losses.

9.3 You agree to indemnify us for all direct and indirect losses we incur as a result of your use of this Site otherwise than in accordance with these Terms of Use.


9. Third party content and links available on this Site

10.1 We are not liable or responsible for the third party content on this Site. Third party content includes, for example, the content of advertisements.

10.2 Where this Site contains links to other sites and resources, which are provided by third parties, these links and resources are provided for your information only and you access them at your own risk. We are not liable or responsible for the content of third party sites or resources. The fact that we include links to such external sites does not imply any endorsement of or association with their operators.

11. General and governing law

12.1 If any part or provision of these Terms of Use is found to be unenforceable, this shall not affect the validity of any part or other provision.

12.2 These Terms of Use shall be governed by English law, and you agree that any dispute between us regarding them or the Site will only be dealt with by the English courts. Nothing shall prevent us from bringing proceedings to protect our intellectual property rights before any competent court.

12. Your Data, Your Rights

You may exercise several rights in relation to the data we process about you. These are:

9.1 You have a right to rectify any incorrect or inaccurate data – please let us know if you believe that we are using any inaccurate or incomplete personal data about you.

9.2 Under certain circumstances, as determined by the Data Protection Legislation, you may ask us to:

  • Erase the personal data we hold and use about you
  • Restrict the way in which we hold and use your personal data
  • Provide you with your data in a re-usable structure, or transmit this to another party at your request
  • Stop holding or using your data for specific reasons, including marketing

9.3 You also have the right to opt out of decision making that is based solely on automated processing (e.g. decisions taken solely by a computer) where the decision has a legal or otherwise significant effect on you.
